Purpose:

This Privacy Policy (the “Policy”) explains how Memorial Matters Inc.(“MM”, “we”, “us” or “our”) collects, uses and discloses Personal Information for the operation of www.memorialmatters.com (the “Site”). The Policy forms part of the Terms of Use of this Site.

Definitions:

In this Policy, we use certain words to mean specific things. This list sets out the definitions we are using for the following words:

Content Contributors”: These are individuals, other than the Site Administrator, who have permission to upload content to an online Memorial. In the case of a private memorial, these will just be the Permissioned Users. If the memorial is public, these will be other individuals as well.

“General Public”: These are individuals who do not use the Site but merely view memorials.

“Other Users”: These are individuals, other than the Site Administator, who may use the site. They include Permissioned Users and the General Public.

“Permissioned Viewers”: These are the individuals to whom a Site Administrator has granted permission to view a private online Memorial.

“Site Services”: These are the Services provided by Memorial Matters when you access the Site. They include the ability to create a Memorial, as well as the ability to lay ‘virtual’ flowers, light a ‘virtual’ candle, upload photos, attach video links, add a memory to the memory book, print content etc.

“Site Administrator”: This is the individual who creates and manages an online Memorial.

“Site Users”: These are any and all individuals who access the Site.

Personal Information We Collect on the Memorial Matters Site

Site Administrators: When you create a Memorial on the site and become a “Site Administrator”, we collect your first and last name, your e-mail address and if you elect to select a payment option (monthly, yearly or permanent) credit card and related billing information.

Other Users: We collect the names and email addresses of Other Users.
It is important for you to remember that while technically information about the deceased and third parties, such as pictures of friends and relatives of the deceased that appear in photographs, is “collected” by Memorial Matters, it is voluntarily posted by users of the Site for their personal purposes. Such Personal Information is not used or disclosed by Memorial Matters for any of its own purposes – the Site has no advertising or third party applications - and therefore is not subject to this Policy. The content of information posted by both Site Administrators and Other Users is addressed in the Terms of Use.

Use and Disclosure of the Personal Information Collected on the Site

When you create a Memorial on the Site under one of the paid options, we use your Personal Information to create the Memorial and to bill you for this service

Administrators and Other Users

We may use your name and email address for the following purposes:

1. Contacting You
Memorial Matters maintains a strict “opt-in” policy with respect to contacting you. That means that you decide up-front what information about our products and services you are interested in receiving from us. For example, you may wish to receive celebrity and public figures’ memorials, the monthly Inspirational Poem, Newsletter or marketing materials. We ask that you check the box to let us know what information to send to you. If at any time you no longer wish to receive this information, merely click unsubscribe located at the bottom of one of our e-mails, or contact us at: [email protected]. Please allow us 7 days to process your unsubscribe request.

2. Enforcing our Terms of Use
We may also use your Personal Information to enforce the Terms of Use of this Site, protect against misuse or unauthorized use of this Site, or to investigate allegations of breach of the Terms of Use of the Site. In the event that we retain a third party to conduct any of these activities, we may have to transfer your Personal Information to them for the performance of the service. In the event that we do so, we will ensure that we have an agreement in place with such party limiting their use of your Personal Information to the provision of these enforcement services and obliging them to protect it in a manner equivalent to that provided by Memorial Matters.

Subject to the exceptions below, we do not trade, sell or otherwise disclose to any third parties any of the Personal Information you provide to Memorial Matters without your consent, unless required by law.

The Exceptions:

1. Use of Third Party Site Services
When you use the Site Services, your ISP is provided to one of our service providers and you are automatically linked to their site. Please note that once you leave the Memorial Matters Site this Policy ceases to apply and your information is dealt with in accordance with the Terms of Use and Privacy Policy of the service provider’s site.

2. Sale of the Company
Should Memorial Matters or substantially all of its assets be acquired by, or transferred to another company or in the unlikely event that Memorial Matters goes out of business or declares bankruptcy, the Personal Information Memorial Matters has collected for the operation of this Site will be transferred to or acquired by the third party. The third party will use your Personal Information in the same manner as described in this Policy, subject to any changes they may make to the operation of this Site and the Policy.

If Memorial Matters voluntarily ceases to operate for any reason, your Personal Information will be retained for 7 years and then destroyed.

Accuracy of Personal Information on Memorial Matters
It is your responsibility to ensure that the Personal Information on Memorial Matters is as accurate, complete and up-to-date as is necessary for the maintenance of your account and ability to access the Site Services.

Storage and Retention of Personal Information
Your Personal Information may be stored outside of Canada and the governments, courts or law enforcement or regulatory agencies of those countries may be able to obtain disclosure of your personal information through their domestic laws.

Memorial Matters retains your Personal Information for as long as you maintain an account with us and access the Site Services. Should you no longer wish to maintain an account with us, you have two options:

Account Deactivation: If you are not sure about maintenance of your account, you may deactivate it by advising us at [email protected]. Within forty-eight (48) hours the Memorial will not be available on the Site. We retain the information in the deactivated account and the associated Memorial for ninety (90) days. We provide you with this period of time so that you do not have to recreate all of the information on the Memorial and the Personal Information you have provided to us. At any time during this period you may advise us that you wish to reactivate it by contacting us at: [email protected] . After the expiration of the ninety-day period, Memorial Matters will permanently delete all of your Personal Information and the Memorial you have created.

Account Deletion: You may delete your account by contacting us at: [email protected]. Your account and the Memorial will be deleted within 48 hours. When you choose this option, the Memorial which you have created and the Personal information you have provided to us is permanently deleted. Should you or someone else subsequently decide that you wish to reinstate the Memorial, you must resubscribe and recreate all of the Memorial content. Therefore please carefully consider your decision to delete your account before you do so.

Security of Your Personal Information
Memorial Matters uses industry appropriate security measures to protect your Personal Information against loss or theft, as well as unauthorized access, disclosure, copying use or modification. The safeguards include technical, administrative and physical security safeguards. All of the information on Memorial Matters is backed up on a regular basis.

Users that are 16 Years of Age or Younger
Memorial Matters does not knowingly collect Personal Information from children under the age of 16. Children under the age of 16 require the permission of a parent or guardian in order to submit their Personal Information to the site. The parent or guardian will be responsible for this Personal Information on the site. Should Memorial Matters become aware that Personal Information has been collected from a child under the age of 16, we will make reasonable efforts to contact the parent or guardian of the child.

Modifications and Updates to this Policy
Memorial Matters may change, edit or update this Policy at any time without notice. You are encouraged to view the Policy whenever you submit information to the site in order to see the current version. For your ease of reference, we have put the date of the last revision of the Policy at the beginning of this document.
